IMPORTANT INFORMATION – PLEASE READ THESE TERMS CAREFULLY BEFORE USING THIS SITE

This Terms of Use Agreement (“Terms”) is a legal agreement between you (“User,” “Client”) and Raw Muse Photo (“we,” “us,” “our”), governing your use of this website rawmusephoto.com and any related domains or subdomains (the “Site”).

By accessing this Site, purchasing any product, or booking any service, you agree to be bound by these Terms. If you do not agree, please discontinue use of the Site immediately.

You warrant that you are at least 18 years of age and legally able to enter into a valid contract.

1. Intellectual Property

All photographs, images, videos, text, blog posts, templates, workshops, digital downloads, and design elements (“Products”) on this Site are the intellectual property of Raw Muse Photo.

You may not copy, reproduce, resell, modify, distribute, or use Products or Site content for commercial purposes without written permission.

Portfolio work shown on this Site may include collaborations with clients or brands but remains part of Raw Muse Photo’s creative showcase.

You are granted a non-exclusive, non-transferable license to use purchased digital Products for your personal or business use, provided that you do not resell, redistribute, or misrepresent them.

2. Purchases, Payments & Refunds

All sales (digital downloads, workshops, services, or sessions) are final. No refunds or returns will be provided.

Deposits made to secure photography sessions are non-refundable.

No final images, deliverables, or downloads will be released until full payment has been received.

We are not responsible for lost, misplaced, or incorrectly downloaded Products. Replacement download links may be provided one time upon request within 24 hours.

3. Photoshoot: Timeliness & Conduct

Clients must arrive on time and prepared.

A 15-minute grace period is allowed. After 15 minutes, a late fee of $500/hour applies. After 30 minutes, the session may be canceled and payment forfeited.

If a client creates a hostile, toxic, or disrespectful environment, we reserve the right to end the shoot immediately and retain the full session fee.

4. Cancellations & Rescheduling

Session dates are secured only with a deposit.

Cancellation policy:

Less than 2 weeks before: deposit is non-refundable.

Less than 1 week before: 50% of the package fee is due.

Less than 1 day before: full package fee is due.

Reschedules due to emergencies, illness, or weather must be completed within 3 months of the original date or the fee is forfeited.

If we cannot perform the session due to illness, family emergency, or unforeseen events, a full refund of payments received will be issued within 5 business days.

5. Delivery of Images & Products

Clients will receive a digital gallery of edited images within 2 weeks of the session date unless otherwise agreed in writing.

Turnaround times for workshops, templates, or educational materials will be specified at the time of purchase.

6. External Links

This Site may contain links to third-party websites. Raw Muse Photo is not responsible for the content, practices, or privacy policies of external sites.

7. Privacy & Data

Any personal data collected through contact forms, bookings, or purchases will only be used for communication, services, or updates.

Data will never be sold or shared without consent.

8. No Warranties

All services, Products, and Site content are provided “as is” without warranties of any kind, express or implied. We make no guarantee of specific outcomes, business success, or results.

9. Limitation of Liability

To the maximum extent permitted by law:

Raw Muse Photo is not liable for damages, losses, or claims arising from your use of this Site, Products, or services.

Liability, if any, shall not exceed the amount you paid for the Product or service in question.

10. Indemnification

You agree to indemnify and hold harmless Raw Muse Photo from any claims, damages, or expenses (including legal fees) arising from misuse of the Site, Products, or violation of these Terms.

11. Governing Law

These Terms are governed by the laws of New York, United States. Any disputes shall be resolved exclusively in the state or federal courts of New York, NY.

12. Updates to Terms

We may update or modify these Terms at any time without notice. Continued use of the Site constitutes acceptance of the revised Terms.
